1. Acceptance of Terms

By downloading, installing, accessing or using the Reelzy mobile application or website (collectively, the "Platform"), you ("User") confirm that you have read, understood and agree to be legally bound by these Terms and Conditions ("Terms"), our Privacy Policy and our Refund & Cancellation Policy.

If you do not agree to these Terms, you must immediately discontinue use of the Platform. These Terms constitute a legally binding agreement between you and Elvarex Private Limited ("Company", "we", "us", "our"), incorporated under the Companies Act, 2013, with registered office at Door No. SP-7A, AWFIS Primus Building, Guindy Industrial Estate, Chennai, Tamil Nadu, India - 600032.

Reelzy operates as an intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000, and complies with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules 2021").

2. Eligibility

• You must be at least 13 years of age to access or use the Platform.
• Users under 18 years of age must have consent from a parent or legal guardian.
• By using the Platform, you represent and warrant that you have the legal capacity to enter into a binding contract under applicable Indian law, including the Indian Contract Act, 1872.
• You must not access the Platform if you are barred from receiving services under Indian law or other applicable laws.

3. User Account

• You may browse the Platform as a guest. To interact (like, follow, comment, gift), you must register.
• You agree to provide accurate, current and complete information including your full name, address, email ID and mobile number during registration.
• You are solely responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
• You must notify us immediately at admin.elvarex@gmail.com if you suspect any unauthorised use of your account.
• We reserve the right to suspend or permanently terminate accounts for violation of these Terms, misrepresentation, fraud or at our discretion.
• One user may not operate multiple accounts. Creating fake or impersonation accounts is strictly prohibited.

4. User-Generated Content

Your Rights

You retain ownership of content you create and upload to the Platform. By uploading, you grant Elvarex Private Limited a non-exclusive, royalty-free, worldwide, transferable, sub-licensable licence to host, store, use, display, reproduce, modify, adapt, publish and distribute such content on the Platform and for promotional purposes.

Content Standards

All content uploaded must comply with applicable Indian laws including the IT Act 2000, the Indian Penal Code, 1860, the POCSO Act, 2012 and the Representation of the People Act, 1951. Content must not:

• Be obscene, pornographic, child sexual abuse material (CSAM) or violate the Protection of Children from Sexual Offences (POCSO) Act, 2012
• Be defamatory, libellous, harassing, threatening or abusive
• Infringe any copyright, trademark, patent or other intellectual property rights
• Promote hatred, violence or discrimination on the basis of religion, race, caste, sex, nationality or language
• Contain misinformation or fake news that may cause panic or unrest
• Impersonate any person or entity or misrepresent affiliation
• Violate the privacy of any individual

Content Moderation

We may remove, restrict or disable access to content that violates these Terms within 36 hours of receipt of a court order or government notification, and within 24 hours for content related to CSAM, nudity, national security or public order, as required under IT Rules 2021.

5. Prohibited Conduct

You must not:

• Attempt to gain unauthorised access to the Platform, other users' accounts or our systems
• Use bots, scrapers or automated tools to access the Platform without our written consent
• Transmit viruses, malware or any harmful code
• Spam, phish or engage in any fraudulent activities
• Solicit personal information from minors
• Use the Platform for any commercial purpose without our written consent
• Engage in money laundering, financing of terrorism or any activity prohibited under FEMA, PMLA or any other Indian law
• Circumvent, disable or interfere with security features of the Platform

6. Intellectual Property Rights

The Platform, including its design, code, trademarks, logos, and all proprietary content, is the exclusive property of Elvarex Private Limited and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999 and other applicable Indian intellectual property laws.

You may not copy, modify, distribute, sell or lease any part of the Platform or its content, or reverse-engineer any part of the Platform, without our prior written consent.

7. Payments, Memberships & Virtual Gifts

• All prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes (GST) unless stated otherwise.
• Payments are processed through secure, RBI-authorised payment gateways. We do not store your card or UPI credentials.
• Membership plans are as described on our Pricing page. Subscriptions auto-renew unless cancelled.
• Virtual gifts (digital tokens of appreciation to creators) are non-transferable and have no cash value.
• We reserve the right to modify pricing with 30 days' notice to registered users.
• For refunds and cancellations, refer to our Refund & Cancellation Policy.

8. Disclaimers & Limitation of Liability

The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding uninterrupted or error-free service.

To the maximum extent permitted by applicable law, Elvarex Private Limited's total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount paid by you for our services in the 30 days preceding the claim.

We are not liable for any content uploaded by users. As an intermediary under Section 79 of the IT Act, 2000, we are exempt from liability for third-party content subject to compliance with the due diligence requirements under IT Rules 2021.

9. Suspension & Termination

We may suspend or terminate your access to the Platform at any time, without prior notice, if we reasonably believe you have violated these Terms, applicable law, or upon direction of a government authority or court.

You may deactivate your account at any time by contacting us at admin.elvarex@gmail.com. Data deletion requests will be processed as per our Privacy Policy.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiations. If unresolved within 30 days, disputes shall be subject to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration at Chennai, Tamil Nadu.

Subject to the arbitration clause above, you agree that courts in Chennai, Tamil Nadu, India shall have exclusive jurisdiction.

12. Changes to Terms

We reserve the right to amend these Terms at any time. Amended Terms will be posted on this page with a revised effective date. Continued use of the Platform after any amendment constitutes acceptance. We will notify registered users of material changes via in-app notification or email.
